What kind of patent do you need?
Patent filing varies according to the invention and technology; there are three types of patent and they are
• Utility Patent
• Design Patent
• Plant Patent
Each type of patent has their own unique ability and criteria and also a certain area of invention can have more than one patent.
Utility Patent:
Utility patent is a patent that protects the invention of a new or improvised technology, product, machine or process. Utility patent is also referred as “Patents for invention” which forbids the third parties from making profit without their endorsement.
The procedure for obtaining a utility patent may be taking a lot of time and expensive but it gives the inventors the exclusive rights to own and stop others from utilizing the technology.
Design Patent:
Design patent is another way of legal protection of a distinctive visual design of an invention, Design patent will be granted only if the product has a well-defined design or positioning, also design patent gives shield for a design which has empirical utility.
According to the USPO a design patent can only involve single claim, Design patent costs lesser than utility patent and you will be impersonator if you don’t file a patent for your design. Design Patent is different from utility patent and the main difference is design patent lasts up to 14 years but utility lasts up to 20 years.
Plant Patent:
The word “plant patent” itself clearly explains that filing a patent for a living organism and is all about the plants. If you have invented a new plant hybrid then you file a patent and when you find a new variety of plant also then plant patent can be filed.
A plant patent is a form of intellectual property that forbids others from using, selling, or exchanging a plant's distinctive qualities. By banning competitors from using the plant, a plant patent might help an inventor increase their revenues while their invention is still under patent protection. Potatoes and other tubers are also ineligible for plant patents, as are any plants that are special simply due to their growing environment or soil quality.
